Nirvana vs. Marc Jacobs Lawsuit: Love, Frances Bean, Nirvana Members to be Called as Witnesses
Hey, wait…Nirvana‘s legal complaint against designer Marc Jacobs might result in court appearances from Courtney Love, Frances Bean Cobain, Dave Grohl and Krist Novoselic.
After Nirvana L.L.C. filed suit last year against Jacobs for unauthorized use of the Nirvana happy face logo in his “Redux Grunge Collection”, Jacobs has filed documents that, per The Blast, are planning on calling Love, Cobain, Grohl and Novoselic as witnesses in the copyright infringement case.
Attorneys for Jacobs argue that the case should be thrown out of court, because of the copyrighted Nirvana logo, “…includes the word ‘Nirvana. The Accused Products do not. The [copyrighted logo] includes the Flower Sniffin Writing. The Accused Products do not. The [copyrighted logo] includes a smiley face with Xs as eyes. The Accused Products do not; they use a different letter for each eye, the letters M and J, signifying Marc Jacobs.”
Whether or not a judge will rule that those differences are enough to throw out the copyright lawsuit has yet to be decided, but the Marc Jacobs design is awfully close to the Nirvana logo. This will certainly be an interesting case to follow in the near future.
